hThese Terms & Conditions (“Terms”) govern the services provided by ConstructivGrowth (“we”, “our”, “us”) to you (“Client”, “you”). By engaging our services, you agree to these Terms.
1. Services
We provide marketing services including (but not limited to) lead generation, appointment setting, and related digital marketing support. The scope of services will be outlined in your service agreement or proposal.
2. Payment & Billing
Pay-Per-Lead/Appointments: You agree to pay a fixed fee of per qualified appointment as defined in Section 3.
Payments are processed automatically via Stripe using the payment method you provide.
All fees are exclusive of VAT (if applicable).
Failed payments must be resolved within 5 business days to avoid suspension of services.
3. Definition of a Qualified Appointment
An appointment is deemed qualified if it meets the agreed criteria (e.g., business type, location, budget, decision-maker role).
Leads collected are initially placed in a Lead Opportunity Stage (non-billable).
After manual qualification by our team, leads that progress to the Qualified Opportunity Stage or result in a booked appointment will be billable.
4. Client Responsibilities
You agree to:
Provide accurate business information, target audience criteria, and service requirements.
Maintain availability to attend booked appointments.
Notify us within 24 hours if an appointment does not meet qualification criteria.
5. Refunds & Disputes
Charges apply only to qualified appointments.
Disputes over lead/appointment quality must be raised in writing within 3 business days of delivery.
If a lead is proven unqualified under the agreed criteria, a credit or refund will be issued at our discretion.
6. Term & Termination
These Terms remain in effect until terminated by either party.
Either party may terminate with 30 days’ written notice.
We may suspend or terminate services immediately if payments are overdue or these Terms are breached.
7. Compliance & Data Protection
We comply with the Data Protection Act 2018.
Any personal data shared will be processed in accordance with our Privacy Policy.
You agree not to misuse or resell leads provided.
8. Limitation of LiabilityWe do not guarantee specific sales outcomes. Our liability is limited to the total fees paid in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
